Seattle Man Arrested for Trespassing and Property Damage After Breaking into Apartment

Phillip Marshall Johnson was arrested on February 13, 2025, after breaking into an apartment on Belmont Avenue in Seattle. The Seattle Police Department responded to a report of a residential burglary at 9:28 PM, where a person was spotted climbing through a back window.
Seattle police arrived at the scene to find the apartment's owner, Duane Fox, who confirmed that no one had permission to be in his apartment. Officers found the suspect, Phillip Johnson, hiding under a blanket in a bedroom. Johnson was promptly arrested without incident.
Inside the apartment, officers discovered that multiple food items had been consumed, and various items had been moved. It was also reported that furniture had been soiled.
Johnson, who reportedly sought shelter, was placed under arrest for residential burglary. However, further investigation found insufficient evidence to charge him with burglary, as it was determined his actions were more aligned with seeking shelter rather than committing additional crimes against property or persons.
With prior similar incidents on record, Johnson is referred to the Seattle City Attorney's Office for potential charges of property destruction and criminal trespass. The investigation and cases were screened by the King County Prosecutor’s Office, aligning with similar conclusions in past cases.
Johnson remains in custody as the Seattle City Attorney's Office reviews the appropriate charges.
